Unfair Competition & Competitive Intelligence

Sometimes referred to as Competitor Fraud, it may arise from predatory sales practices, such as selling below cost, freebies and giveaways to selected customers.  More likely, however, unscrupulous competitors resort to theft of technology, trade secrets and proprietary information such as patents and trademarks.  Today, theft of your proprietary information is more likely than theft of your finished product.  Computers and the trust we place in employees, vendors and customers all create a lucrative theft environment.

Did you know that Competitive Intelligence is a profession?  There is actually an organization devoted to competitive intelligence!  How easy, do you think, it would be for someone in that mindset to step over the line into Competitor Fraud?

Always maintain non-disclosure agreements and non-compete clauses in your day-to-day business affairs.  They may be your only legal recourse when problems come up.
